1. Introduction

2. Definitions

 

In these Terms and Conditions unless the context otherwise requires;

​

2.1. Company or We shall mean JOURNEYLABEL (OPC) PRIVATE LIMITED and also includes all its brands and divisions namely JourneyLabel or branch offices;

 

2.2. Customized holiday means a tailor-made holiday wherein Tour Itinerary is designed as per the individual requirements of each guest.

 

2.3. Group Tours mean such tours which are carried out in groups containing various individuals’ or families and where the services provided are similar to all the guest/s or tour participants in that group.

 

2.4. Corporate tours mean dedicated tour of planning, booking, and facilitating meetings, incentives, conferences, exhibitions, seminars, and other events of corporates.

 

2.5. Third-party contractor/service provider means supplier of any infrastructural facility and shall include hotel managements, airlines, caterers, restaurants, places of entertainment like theme parks, museums, art galleries, cruise, coach who are to provide the services to the tour participant/ Guests.

 

2.6. First day of the tour shall start at any time (i.e. in the morning/afternoon/evening) at the first destination depending on the arrival of the respective flight/train/cruise or any other mode of transport and the same shall be in case of the last day of the tour. In other words, a 'Day' shall mean a part of the day or 24 hours or its part thereof.

 

2.7. Force Majeure means an event or circumstance not within the reasonable control, directly or indirectly, of Company in its ability to perform its obligations/responsibilities regarding the tour including

​

  • war, hostilities invasion, act of foreign enemies;

​

  • rebellion, revolution, insurrection or military or usurped power or civil war;

​​

  • epidemic, explosion, fire, flood, earthquake or other exceptional natural calamity and act of God;

​​

  • ionizing radiation or contamination by radioactivity from any nuclear fuel, or from any nuclear waste from the combustion of nuclear fuel, radioactive toxic explosive, or other hazardous properties of any explosive nuclear assembly or nuclear component of such assembly;

​​

  • riot, commotion or disorder;

​​

  • any act or omission of any Government instrumentality;

​​

  • a Change in Legal Requirements;

​​

  • strikes, lock outs or other industrial disturbances; and

​​

  • abnormal weather or sea conditions including tempest, lightning, hurricane, typhoon, rain and temperatures.

 

2.8. Guest/s or Tour participant means all the customers, tourists, travelers, vacationers, sightseers, visitors, backpacker who have registered their names or enquired about tour/ holiday package or booked the tour by making part or full payment for any scheduled tours, customised packages or any other travel related services provided by Company;

 

2.9. Jain food means food without onion, garlic and potatoes served at the time of tour groups meals not necessarily before sunset and may or may not be served on the table.

 

2.10. Meal means breakfast, lunch, dinner and/or any other snacks supplied.

 

2.11. SIC tours stands for Seat-in-Coach Basis Tours, which means you will share an air-conditioned (unless specified) coach or van shared with other tourists.

 

2.12. Tour/s mean any Domestic/International Tours organised or arranged or facilitated by the Company.

 

2.13. Tour Escort / Leader / Manager / Assistant by whatever designation called means a person designated by Company to help / guide / assist the guest/s or tour participant in & or during India and / or International tours organised by Company.

3. Use of website

3.1.  The content of the pages of this website is for your general information and use only. It is subject to change without notice.

 

3.2. Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.

 

3.3. This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

 

3.4. Unauthorised use of this website may give rise to a claim for damages and/or be a criminal offence.

 

3.5. The Company hereby expressly disclaims any implied warranties imputed by the laws of any jurisdiction or country other than those in India. The Company considers itself and intends to be subject to the jurisdiction only of the courts of Mumbai, India.

 

3.6. You agree and acknowledge that the company will have the right of indemnification for any loss that may be caused to company for any misuse of its website by you and the company will have all rights to approach any court of law for enforcement of such rights.

4. Alteration or amendments to terms & conditions

Company reserves the right to change the terms & conditions and notices under which the services are offered through the Website, including but not limited to the charges for the services provided through the Website. The User shall be responsible for regularly reviewing these terms and conditions.

JourneyLabel is the owner of this website and holds the copyright in respect of this website. The content provided in this site may be protected from copyrights, trademarks or other intellectual property rights and laws. Content includes the text, graphics, button icons, audio and video clips, digital downloads, data compilations and software. The user may use this for general purpose only and it shall not be used for any commercial purpose or shall not be copied, reproduced, republished, uploaded, posted, transmitted or distributed without the written permission of company, and/or its third-party providers and distributors. Unauthorized use of this web site (including any content posted on this website) including but not limited to unauthorized entry, misuse of passwords, or misuse of any information posted on this site is strictly prohibited and would attract both penal actions.

6. Terms & Conditions in relation to product & services offered

​

6.1.  COMPANY’S REPONSIBILITY

 

The Company is engaged in planning, arranging and organising tour, travel or holiday for its clients. As the company is service facilitator only, fulfilment of travel services/ tours/ holiday package organised by company is dependent on timely fulfilment of services by Airline, Railways, Transport operating company, Hotel, Amusement park or any other third-party contractor. User of this website are informed that company do not control such third-party contractor/ service providers and does not assume any responsibility for any deficiency, non-performance or default, if any, in services of such third-party contractors/ service providers. The company endeavours to provide best alternatives, if possible, on chargeable basis in case any of such event occurs for the benefit of tour participant. However, company does not give any assurance or guarantee of sourcing other alternative for the tour participant. 

 

6.2.  ITINERARY

 

Due to unavoidable circumstances (force majeure conditions or others), there is a possibility that itinerary may be required to be altered or changed. The company reserves the right to alter, vary or withdraw itinerary or package in such circumstances. In the event of change in itinerary, no claim for refund or compensation shall be entertained by the company.

 

6.3.  TRANSPORT

 

For portions of your itinerary involving air transport, cruising, or travel by coach, car, train, or ferry, you will be subject to the operational terms and conditions of the carrier and the regulations under which they operate. Operating carriers are solely responsible for operating transport facility and servicing passengers on board, failure to provide proper services or any deficiency in services like loss of baggage, failure on the part of transport company to accommodate guest/s despite having confirmed tickets, delays, change in date or time, no permission to board, etc. the company shall not entertain any claim of whatsoever nature by the guest/ tour participant against the company. Cancellation charges plus deposit forfeit charges as applicable under the rules of the concerned operating carrier are to be paid by guest/ tour participant immediately in the event of cancellation by such tour participant.

 

Any increase in Airport Taxes/Airport Development fees payable to the respective Airport shall be borne and payable by guest or tour participant.

6.4.  LAND ARRANGEMENTS - ACCOMMODATION

 

Selection of Hotels for accommodation are done based on quality and convenience of tour participant.  Rooms are allotted on twin / triple/ single basis and children with or without bed basis depending on composition of the family/group.  Most of the rooms have a private bath or shower, Air-conditioning, central heating and other facilities as provided by the hotels depending upon various factors including weather / climatic conditions, local systems, tour type, etc. We cannot guarantee the availability of adjoining rooms / interconnecting rooms / non- smoking room / rooms on the same floor etc.

 

Check in and Check out time:  Every guest has to abide by the check-in and check-out time of the respective hotels. Generally, the check-in time is 1500 hrs and check-out time is 1000 hrs. However, check-in and check-out may also differ depending upon destination, hotel policy, etc. If guest wants any change therein, guest should manage the same at his own cost with hotel authorities on payment of additional charges, if any.

 

Hotel Security Deposit: A security deposit may be demanded by hotels at certain locations in order to offset cost of any other service/s used by the tour participant, besides what is included in the tour package.

 

All baggage and personal effects are at all times and under all circumstances your responsibility. We will not be responsible or liable in case of loss of such items from the hotel premises or place of visit etc. Some hotels offer the facility of safe deposit lockers, which can be availed of by you at your own cost and risk. The company will not be liable for any loss/theft from the same.

 

Any damages caused to the hotel rooms or hotel property or place of visit etc. during stay /visit, shall be borne and payable by guest, and the company will not be accountable for the same.

 

Company is not accountable if there is sudden disruption/disorder of telephone, internet services, and other amenities while staying at the hotels. The company will also be not responsible for the facilities provided or not provided in the room/bathroom/hotel premises etc. by the Hotel or its staff.

 

Tour participant availing additional facilities over and above provided by Company such as mini-bar, paid television channels as well as any telephone/internet facilities are not included in tour cost and guest/s shall bear the expenses for the same.

 

6.5.  LOCAL TRANSFERS

 

Generally, air conditioned/air-cool coaches are hired for local transfers. However, at times due to weather extremity the air condition may not work or will not be much effective we are not responsible for any malfunction/defect in the coach/ bus.

Due to fixed entry timings at sightseeing destinations and fixed working hours of local transport provider, tour participants are requested to always be on time. Any missed transfers leading to missed sightseeing opportunities will not qualify for refund or compensation.

 

6.6.  MEALS

 

Meal plan are pre-set for the tour and the same will be as specified clearly in the itinerary. Unlike an airline or restaurant, we cannot provide a special meal, nor do we guarantee a special diet to the client, except to the extent mentioned in the itinerary. We however reserve the right to change the meal arrangement if circumstances make it necessary to do so. Breakfast/ lunch / dinner may be packed depending on the itinerary scheduled for the day.

 

As the meal timings are fixed and defined as per hotel policies the tour participant will not be entitled to breakfast or lunch on arrival or departure day where the check in and checkout time falls outside the meal timings. In the event of whatsoever reason, the client misses any meal including breakfast offered to him by the company, then no claim can be made for the meal/breakfast, which he has missed and not utilized.

 

6.7.  BAGGAGE

 

Tour participant are informed that the company is a service organizer/ facilitator only. Thus, all tour participant shall ensure that they adhere to terms and conditions of third-party service providers in addition to ours. In relation to baggage, tour participant shall ensure that they follow baggage policy of transport operating company (i.e. airline, cruise company and rail network). Tour participants shall be responsible to refer to the most updated policies, the company shall not be responsible to reimburse any extra charges levied by such transport operator. 

 

6.8.  TRAVEL DOCS & VISA

 

Tour participant shall ensure that they have all the required travel documents and identification required for entry, departure and travel to each country or region. Valid travel documents include but not limited to, passport, visas, tickets at all times for travel. The company may assist tour participant for assistance in the visa application process on a chargeable basis, however, issuance of visa is solely under the discretion of the Consulates / Embassies. Please note that the company only acts as visa facilitator. We do not hold any responsibility in case of any rejection of visas. Cancellation policy will be still applicable even if the visas gets rejected. Visa application fee once paid will be non-refundable. Re-application of visa, if required may result in additional fee depending on rules and regulations of the relevant Embassy.

 

The company will not be responsible for any loss of tour participant of visa fees, charges paid for hotel booking, air fare etc. due to any default, delay on part of tour participant like delay in submission of documents for visa, visit to visa office, etc.

 

6.9.  INSURANCE

 

Tour participants are advised and recommended to avail/ obtain adequate Insurance Policy and Overseas Travel Insurance cover as per requirement of Government of the Country concern to meet expense including medical, legal hospitalization, accident etc. during the tour. The Company reserves the right to call for any written certification of guest/s’ medical fitness before departure. Company is not liable / responsible for any reason whatsoever, for settlement of insurance claims and it is a matter solely between the concerned insurance company and the tour participant / guest/s. In case of any unfortunate event while on tour like hospitalization and/or unfortunate demise, it shall be the sole responsibility of the guest/s and/or relative of the hospitalized person/deceased to submit the necessary claim to insurance authorities for further processing of the claim.

 

6.10. TRANSFER OF TOUR/ FUTURE TOUR

 

In case tour participant wants to transfer/ change originally booked tour to another tour (e.g. Europe tour to America tour), it shall be treated as cancellation of original tour and therefore a fresh booking of another tour has to be made.

 

All cancellation charges shall apply on tour tariff and not on discounted tour tariff for the previously booked tour. The tour tariff and discounts available for the cancelled tour are not valid for fresh booking. Tour tariff and discounts prevailing on the date of fresh booking of another tour shall be applicable.

 

6.11. PRICES/TAXES/PROMOTIONS/OFFERS

 

Price of holiday package or tour shown on website and marketing material of the company are based on price inputs that are available at the time of printing and /or uploading on website. Tour price may vary or change at the time of actual booking which may be due to various factors like change in airfares or hotel tariff, etc.: Porterage and tipping is customary in all parts of the world for services rendered and the same is not included in tour price. Tour participant will be required to pay city tax on per night stay basis directly to the hotel in the cities visited as per local rules of the city administration.

 

In case of special offers, promotions or schemes, additional terms and conditions of the offers, promotions or schemes will be applicable in addition to these terms and conditions. You might have to adhere to the payment schedule prescribed under such offers, promotions or schemes in order to be eligible to avail benefits under such offers, promotions or schemes. If you fail to make the payment by the due date and/or do not comply with all the terms and conditions of the offer, promotion or scheme you would not be entitled to receive the benefit under such offer, promotion or scheme.

 

6.12. INSTALLMENT PAYMENT FACILITY

 

Tour participant can avail the facility of paying for the tour in convenient monthly instalments against select credit cards as per the rules and regulations of the company in this regard. It should be noted that company is only a facilitator while the authorization of this transaction is at the sole discretion of the bank on their terms and conditions. The legal relation between the Company and the Client would not change by virtue of the Client seeking such loan from the bank.

7. Refund

​

7.1.  Refunds if any, for variation, modification, amendments, alteration and/or cancellations etc. of any tour/ holiday package shall be paid directly to the guest by 'A/C payee' cheque, in Indian Rupees at the prevailing rate of exchange on the date of the cheque, as per Reserve Bank of India Rules and Regulations. Processing refunds can take up to 45 days from the date of firming up the eligible refund amount by the company.

 

7.2.  The refund shall not be payable:

 

  • For no show or tour participant arrives late at the commencement of tour;

  • If the tour participant along with his family is compelled to discontinue the tour due to any reason such as illness, death, loss of passport.

 

  • For any un-utilised services of the tour including the meals due to whatsoever reason.

 

  • For any non-refundable travel or other services in the scheduled tour. Example: air tickets, etc

 

  • Tour participant shall keep in mind that holiday or tour package is combination of different ingredients sourced from third-party contractors or services providers like hotels, airlines, sightseeing operator, transport operator, Government, etc. Company takes due care in selecting these contractors/ service providers however, any default or non-provision of service or their part shall not make company responsible for refunding tour price to tour participant in full or in part.

 

7.3.  Due to inevitable circumstances (force majeure or other), company may have to modify or cancel the scheduled tour. In such cases, the company will offer you alternative tour dates / tours / holiday package. If the alternative date / tour is not acceptable, company would refund the money paid by you without interest after deducting any costs incurred by us on your behalf, within a period of 45 days from the date of revision or cancellation. However, we would not be responsible or liable to pay any reimbursement or damages or substantial loss or to refund any other expense incurred by you.

8. Cancellation

​

If tour participant wants to cancel the booking of tour, they must inform the company in writing. For the purpose of this clause, cancellation could be for any reason whatsoever including medical, accident, death, court order, non-availability of passport and / or visa or delayed or non-payment of balance amount within final due dates. Cancellation charges shall be charged by the company for cancellation of booked tour/ services by tour participant for any reason as per company.

9. Liability for third party contractors/service providers

​

A Tour involves making arrangement with accommodation providers, activity providers, airlines, cruise lines, coach companies, transfer operators, tour and local guides, and other independent parties (“Third Party contractors/ service providers”) to provide you with some or all of the components of your booking. Although, we take all reasonable care in selecting these third-party contractor / service providers, we are unable to control them and therefore cannot be responsible for their acts or omissions. Any services provided by them are subject to the terms and conditions imposed by these third-party contractor/ service providers and their liability is limited by their tariffs, conditions of carriage, tickets and vouchers and international conventions and agreements that govern the provision of their services.

 

The company shall not liable or will not assume any liability / responsibility for any claims, losses, default, deficient services provided by any of these third-party contractors / services providers or its employees.

10. Liability & responsibilities of company

​

The Company and its employees, officers, representatives shall under no circumstance whatsoever be held liable for:

 

  • any damage to, or loss of, property or injury to, or death of, persons occasioned directly or indirectly by an act or omission of any third-party contractor / service provider, including but not limited to any defect in any aircraft, watercraft, or vehicle operated or provided by such other provider;

 

  • any loss of baggage or property of tour participant due to mistake or negligence of tour participant or its co-traveller or by the third-party contractor / service provider;

 

  • any loss due force majeure situation or situation beyond company’s control;

 

  • in case any loss incurred to tour participant due to negligence of company or its employees then our liability arising in any way out of this contract in respect of any of our services shall not exceed the respective tour cost and shall in no case include any consequential loss or additional expense whatsoever.

 

  • any delays due to third-party transport operator, on account of any reason whatsoever rescheduling/cancellation etc;

 

  • any overstay expenses on account of Force Majeure including weather conditions, strike, war, quarantine, or any other reason whatsoever;

 

  • any sightseeing missed and/or the program being curtailed after commencement of the tour and/or before the due period on account of Force Majeure including any unavoidable circumstances and any reason beyond company control including political, natural calamity, monument under renovation, VIP movement and security, heavy rush at sightseeing places, road traffic congestion etc; and

 

  • mis-allocation of seats food service or any deficient service by any of the third-party contractor.

11. Complains/Grievances

​

We take all complaints and grievances very seriously. Tour participant having any complaints regarding tour/ holiday package can write to us on Complaint@JourneyLabel.com.

​

The Company assumes no liability for complaints that are not properly brought to the attention of the company and cannot resolve or attempt to resolve complaints until proper notice is provided. If the guest has any claim, grievance and / or complaint in respect of services provided by company during tour, the tour participant shall inform company not later than 48 hours. Any complaints/ grievances received by company post 48 hours of tour completion shall not be entertained.

12. Governing Law & Jurisdiction

​

These conditions are governed by and construed in accordance with the laws of India. All disputes pertaining to the tour and any claim arising there under shall be subject to the court of competent jurisdiction at Mumbai only.
